Disrepair

Landlords are required by law to ensure that your property is kept in good repair. 
When this does not happen, we may be able to help by acting on your behalf under Section 11 of the Landlord and Tenant Act 1985. In addition, the Homes (Fitness for Habitation Act) seeks to improve housing conditions, and it is a requirement as an implied covenant that homes should be ‘Fit For Human Habitation’. The ‘fitness’ will be particularly relevant as it demands adequate ventilation and a home free from damp.

The Act covers all shorthold and secure tenancies, where a social landlord owns the property, i.e. Local Authorities and Housing Associations. If you have suffered any inconvenience as a result of disrepair, Antony Hodari Solicitors will work hard to help you receive the maximum compensation as well as making sure the repairs to the property are completed.

To make a claim for housing disrepair, we will look to establish the specific terms and conditions of your Tenancy Agreement. Following a review of the agreement, there may also be some other landlord obligations that may assist in deciding to what extent your landlord is liable for the disrepair to your property.

Damp & Mould Issues

Damp can be caused by a variety of problems which often relate to the structure of your home and can cause health problems for you and your family. Too often, landlords are content to paint over the symptom rather than properly repairing the cause to prevent it from happening again. The Fitness for Habitation Act imposes additional duties on landlords to provide a home free from damp and with adequate ventilation.

Leaks

Does your property suffer from leaks internally? Is it being caused by a leaking roof or from a dwelling above? If so your landlord should repair the problem, redecorate and compensate you for your damaged items.

Vermin

Your landlord should ensure that rats, mice and cockroach infestations are resolved and their entry into the property prevented.

Heating Problems

Your home must have an adequate and reliable source of heating and hot water. Broken boilers must be addressed urgently.

Drains & Gutters

Should be clear at all times and should not overflow.

Structural Cracks

Landlords must address structural movement, which causes worry and distress for tenants.

How much will it cost me ?

We operate on a “no win no fee” basis
We expect to recover our basic fees and expenses from your landlord if your claim is successful. However, you will remain responsible for paying the success fee and the After the Event (ATE) insurance premium.

If your claim is unsuccessful and provided that you’ve fully cooperated with us throughout the process, do not withdraw your claim against our advice, and remain truthful we will not charge you for our fees. The ATE insurance policy is designed to cover any disbursements, such as surveyors’ fees or court fees, as well as your landlord's legal costs. In this scenario, there will be no charges from us, and you will have no financial outlay, provided you meet your responsibilities under the agreement.
