In addition, the Homes (Fitness for Habitation Act) seeks to improve housing conditions, and it is a requirement as an implied covenant that homes should be ‘Fit For Human Habitation’. The ‘fitness’ will be particularly relevant as it demands adequate ventilation and a home free from damp.

The Act covers all shorthold and secure tenancies, where a social landlord owns the property, i.e. Local Authorities and Housing Associations.
